On 19 June 2023, European social partners in the catering industry (EFFAT and FoodServiceEurope) issued a Joint Declaration on “Public Procurement and Collective Bargaining”, calling for a revision of the directive on public procurement. They denounce the fact that “half of the public tenders in Europe are awarded based solely on the lowest price”, thereby incentivising some bidders “to engage in unfair competition and ignore social criteria”. The signatories propose excluding both the lowest price criterion and the obligation requiring companies bidding for public contracts to adhere to collective agreements, in order to promote collective bargaining through public procurement (see press release).
