Unemployment cover for domestic staff
Where their employers are private individuals, domestic staff in Spain are subject to a special social security regime covering all of the normal risks faced by employees, except that of unemployment. As a result, domestic staff are unable to pay contributions to insure themselves against this risk, and thus do not qualify for unemployment benefit when they lose their job. The Court of Justice regards this as indirect discrimination against women and can find no valid justification for it.
