La Commission européenne a adopté, le 13 décembre 2013, une communication relative à un « cadre de qualité de l’Union européenne pour l’anticipation des changements et des restructurations ». Ce texte décevra les parlementaires européens qui attendaient de la Commission qu’elle propose un « acte législatif ».Il ne fait que recycler de façon allégée ce que la Commission avait déjà publié avec la « Check-list restructuration ».
Au sein des entreprises, le document, tout comme la check-list, peut nourrir la négociation d’accords visant à encadrer des restructurations. La Commission annonce qu’elle « examinera s’il convient de le réviser d’ici à 2016 », faisant ainsi de 2015 une année charnière dans la mesure où la Commission présentera sa proposition visant à « consolider les directives sur l’information et la consultation », comme annoncé dans sa communication « Refit » du 2 octobre 2013.
Elle doit aussi établir le rapport d’application de la directive n° 2009/38 sur le CE européen avant le 5 juin 2015. Voilà autant de rendez-vous qui permettront de poser la question du rôle de l’information-consultation dans l’anticipation des restructurations.
